TERMS AND CONDITIONS
These terms and conditions define:
1. Client: Any natural person or legal entity that has instructed Smart Wonen to assist, in the broadest sense, with finding residential or commercial premises by registering at www.smart-wonen.nl
Article 2: Formation of the agreement
2.1 The agreement (property search assignment) is formed by registering (with truthful information) and accepting these terms and conditions online at www.smart- wonen.nl under the Register as a property seeker tab.
2.2 Before an agreement is formed, the client must provide Smart Wonen with valid identification and proof of income.
2.3 All offers of residential or commercial premises made by Smart Wonen, whether written or verbal, are non-binding. The client cannot derive any rights from them.
2.4 If the client is eligible for residential premises for which a housing permit is required, obtaining this permit is the sole responsibility and at the client’s own risk.
Article 3: Registration
3.1 The client (prospective tenant) can register with Smart Wonen entirely free of charge.
3.2 All costs incurred by Smart Wonen in connection with carrying out the assignment shall be borne by Smart Wonen.
Article 4: Services
4.1 Smart Wonen’s services commence after registration on our website: www.smart-wonen.nl
4.2 The services provided by Smart Wonen include property viewings and rental advice.
Article 5: Payment
5.1 If Smart Wonen’s services result in a tenancy agreement for the client, the client shall owe Smart Wonen an administration fee upon accepting the property. This fee must be paid before the tenancy start date (key handover).
5.1.1. ADMINISTRATION FEES =
Administration fee for self-contained accommodation (apartments & houses): €0.00 excl. 21% VAT.
Administration fee for studio: €0.00 excl. 21% VAT.
Administration fee for non-self-contained accommodation: €299 excl. 21% VAT.
Administration fee for non-self-contained student accommodation: Upon presentation of a valid student ID card €199,- excl. 21% VAT.
5.2 The amounts specified in paragraph 5.1.1 of this article are payable to Smart Wonen as a one-off fee and must be paid to Smart Wonen upon signing the tenancy agreement and no later than the tenancy start date (key handover). After accepting the property, the client must make a payment of €99.95 incl. VAT.
5.3 Any legal or extrajudicial costs incurred due to non-payment shall be borne by the debtor.
5.4 If you and/or your associates move into a property obtained through Smart Wonen, you owe Smart Wonen an administration fee.
5.5 You may only move into the property once you have paid Smart Wonen the administration fee, rent and security deposit.
